Terms & Conditions

1) Acceptance of Terms

By creating an account, clicking “I Agree”, or otherwise accessing the ThoughtBloom website, app, APIs, or related services (collectively, the “Service”), you agree to these Terms & Conditions (the “Terms”) and to our Privacy Policy. If you do not agree, please do not use the Service.

2) Eligibility & Account Registration

You must be at least 13 years old (or older where local law requires) to use the Service. Provide accurate information, keep your credentials confidential, and understand you are responsible for all activity under your account.

3) Public‑Beta Notice

ThoughtBloom is in public beta. Features may change, the Service may be unavailable at times, and data loss is possible. The Service is provided “AS IS” and “AS AVAILABLE.” Please keep your own backups of any important content.

4) Service Description & Allowance System

ThoughtBloom offers journaling, music discovery, and conversational features.

Allowances (no monetary value):

Free Tier – daily/weekly allowances currently include:

  • Liner Notes 1/day
  • Listening Room replies 3/day
  • Image uploads 1/day
  • Quick Reflection 1/week
  • Unlimited Soundtracks

Essential Tier (USD 6.99/month) – increased allowances:

  • Liner Notes 10/day
  • Listening Room replies 25/day
  • Image uploads 5/day
  • Quick Reflection 1/week
  • Unlimited Soundtracks

Resets: Daily allowances reset at local midnight; weekly allowances reset Sunday 00:00 local time.

Fair use: Unlimited Soundtracks are subject to reasonable rate limits and abuse controls to protect service quality.

We may adjust features, limits, or plan pricing; material changes will be announced as described in Section 17.

5) Fair Use, Rate Limits, and Abuse

To keep the Service reliable for everyone, you agree not to:

  • Upload unlawful, harassing, infringing, or harmful content.
  • Scrape, crawl, or use automated means that impair performance or exceed reasonable use.
  • Bypass, disable, or interfere with security, rate limits, or allowance controls.
  • Misrepresent activity or tamper with client‑side instrumentation.
  • Create multiple accounts or otherwise circumvent allowances or rate limits.

We may suspend or terminate accounts or block access that violate these rules (see Section 11).

6) User Content & License

You retain ownership of all User Content (journal entries, images, tags, notes, etc.) you submit. You grant ThoughtBloom a worldwide, non‑exclusive license to host, process, and display your User Content only to operate and improve the Service. You represent that you have the rights to your content and that it does not violate any law or third‑party rights.

7) AI & Generated Output

Certain features (e.g., Listening Room and Liner Notes) may use third‑party AI models to generate responses from your prompts and relevant context you provide. AI output may be inaccurate, incomplete, or biased. Do not rely on AI for medical, legal, financial, or other professional advice.

As between you and ThoughtBloom, you may use, copy, and share AI output generated for you, subject to these Terms and applicable law. We may store prompts and results to operate the Service, provide support, prevent abuse, and improve quality.

8) Third‑Party Services (Processors & Integrations)

To deliver the Service, we use trusted providers and share only the minimum necessary data with them:

If we later add or replace providers, we will update this section and/or our Privacy Policy.

9) Product Analytics (Mixpanel) & Cookies

We use Mixpanel to understand feature usage (e.g., which pages are viewed, if a soundtrack was generated, whether daily allowances were reached). We aim to keep analytics pseudonymous and minimal:

  • Typical analytics properties include device type, page route, app build version, plan (“free”/“essential”), and session ID.
  • We avoid sending raw PII such as email to analytics.
  • We may use a stable device identifier (cookie/local‑storage) and hashed signals (e.g., hashed device ID).

We also use cookies/local‑storage to remember preferences, keep you signed in, and protect against abuse. You can control cookies through your browser; some parts of the Service may not function without them.

10) Subscriptions, Billing & Refunds

Paid plans are billed in advance via Stripe. Fees are non‑refundable except where required by law. We may change prices with 30 days’ notice. Late or failed payments may result in suspension or downgrade to the Free Tier.

11) Suspension, Termination, and Data Handling

You may cancel at any time in account settings. We may suspend or terminate the Service (or any account) for violations of these Terms, non‑payment, legal requests, or security/technical issues. After termination, we may delete your User Content after 30 days. System logs and analytics records may be retained for a commercially reasonable period as described in our Privacy Policy.

12) Changes to the Service

We may add, remove, or modify features (including allowances and rate limits). Where changes materially affect your rights or usage, we will provide reasonable advance notice (e.g., email and/or in‑app banner).

13) Disclaimers

Except as prohibited by law, we disclaim all warranties—express, implied, statutory, or otherwise—including merchantability, fitness for a particular purpose, title, and non‑infringement. Third‑party services (hosting, payments, AI, analytics, and music metadata) are provided under their own terms and may experience downtime or changes outside our control.

14) Limitation of Liability

To the maximum extent permitted by law, ThoughtBloom and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business interruption, even if advised of the possibility. Our aggregate liability under these Terms will not exceed the greater of (i) amounts you paid to ThoughtBloom in the 3 months before the claim or (ii) USD 100.

15) Indemnification

You will defend, indemnify, and hold harmless ThoughtBloom and our affiliates, officers, and employees from claims and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Service.

16) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict‑of‑laws principles. Any dispute not resolved informally will be settled by binding arbitration in Comal County, Texas, under the Commercial Arbitration Rules of the American Arbitration Association (AAA). You and ThoughtBloom waive any right to a jury trial or to participate in a class action. Nothing limits either party’s right to seek injunctive relief or to bring individual claims in small‑claims court with proper jurisdiction.

17) Changes to These Terms

We may amend these Terms at any time. For material changes, we will notify you by email and/or in‑app banner at least 7 days before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms.

19) Miscellaneous

  • Severability: If a provision is unenforceable, the rest remain in effect.
  • Assignment: You may not assign these Terms without our consent; we may assign to an affiliate or in a merger/sale.
  • No waiver: A failure to enforce a provision is not a waiver.
  • Entire Agreement: These Terms + the Privacy Policy are the entire agreement between you and ThoughtBloom regarding the Service.
  • Survival: Sections 5–7 and 9–19 survive termination.
